This is a legal document that explains your rights and obligations as a user. Please read it carefully.

  1. Grammati is an online english learning system operated by WebCardinals Ltd under the internet domain grammati.com.
  2. Grammati is available over your internet browser.
  3. With your registration with Grammati you (hereinafter referred to as "user") agree to these terms and conditions (hereinafter referred to as "T&C"). The registration is a valid contract between the user and WebCardinals Ltd, 19 Rawhiti Street, Diamond Harbour, Christchurch, New Zealand (hereinafter referred to as "webCardinals").
  4. The T&C apply to all users of free and paid services provided by Grammati.
  5. webCardinals reserves the right to modify these T&C at any time and without indicating the reason for such modification. A notification about the modified T&C shall be visible to users after their daily exercises. If the user does not object to the modified T&C within a period of four weeks, they are deemed to be accepted. If the user objects, webCardinals may close the user’s account.
  6. Each user may only register once.
  7. User’s email address will not be published anywhere.
  8. The contract between the user and webCardinals regarding the use of Grammati is concluded when the user completes and sends the registration form.
  9. By sending the registration form user confirms acceptance of T&C.
  10. Registration is free of charge to the user.
  11. The registration contract for using 1 question a day learning speed is concluded for an unlimited period.
  12. To terminate any contract (free or paid), the user has to send an email to ContactUs@grammati.com expressing his/hers will to close their account.
  13. Termination will be confirmed in an email sent by webCardinals.
  14. The user account will be deleted upon termination of the free contract.
  15. Grammati offers some free contents and features (1 question a day learning speed).
  16. Grammati offers premium services and products for a charge (5 question a day full learning speed). The user has to explicitly order them (premium contract).
  17. Premium contracts are concluded after successful payment.
  18. The minimum usage period of premium contracts is 30 days from the day the contract is concluded.
  19. Days in which user does not use the service (answer any question) are not deducted from above 30 days period.
  20. Premium services are available according to current offers as one-off purchases.
  21. If prices are quoted at Grammati, they are including the valid statutory turnover tax.
  22. Usage fees for premium services are payable in advance.
  23. Payments are handled by the service provider PayPal.
  24. The user agrees not to use any IP proxying or other methods to disguise the place of your residence, whether to circumvent geographical restrictions on content, to purchase at pricing not applicable to your geography, or for any other purpose. If the user does this, webCardinals may close the user’s account.
  25. When the user achieves access using a voucher code, they will have access to premium service for a limited time.
  26. Billing takes place digitally (email), a paper billing will not occur.
  27. When another user registered using a promo code and later paid usage fee the corresponding user who shared this code will get the same amount of premium service for free. It applies only to the first purchase.
  28. All contracts can be terminated without notice by either party to it at any time.
  29. The user is not entitled to any refund of usage fees if a premium contract is terminated by either party after the first 14 days after concluding the contract.
  30. webCardinals has the right to cancel any contract at any time without giving reasons.
  31. webCardinals has the right to cancel a paid contract when no use of the product has been detected within 6 months.
  32. webCardinals does not warrant or represent that the information provided, is up-to-date, correct, complete or of quality.
  33. webCardinals strives to ensure that Grammati functions properly at all times. However, webCardinals does not guarantee uninterrupted access and shall not be liable for transmission downtimes due to technical reasons.
  34. For providing its service, webCardinals uses the technologies currently and commonly used in the field. To be able to make full use of the services offered by webCardinals, the user must likewise use these technologies (e.g. up-to-date browser technologies) or enable their use on its computer (e.g. activate Java Script, enable cookies). If older or not commonly used technologies are used, the user might only be able to make limited use of the services provided by webCardinals.
  35. Claims for damage on the part of the user are excluded. The exclusion does not extend to infringement of essential contractual obligations which must be met to achieve the goal intended by the contract.
  36. In the event of infringement of essential contractual obligations, webCardinals shall only be liable for contractually typical, foreseeable loss or damage if the infringement was due to ordinary negligence.
  37. In the course of managing agreements and implementing the use, webCardinals collects personal data of users. In doing so, webCardinals shall comply with the statutory provisions. Without the consent of the consumer, webCardinals shall only collect, process and utilise the user's basic and use information insofar as this is required for administering and processing the contractual relationship and for the use of and invoicing for teleservices as well as for providing services to optimise personal availability.
  38. Without the user's consent, webCardinals will not exploit the user's information for the purposes of advertising, market research or opinion polls.
  39. In addition, the user is advised of the entitlement to disclosure, correction and deletion or disabling of personal data in accordance with the provisions of the data protection laws.
  40. webCardinals uses "cookies" to individually design and optimise the user's online experience and online time. A cookie is a text file which is stored either temporarily in the computer's main memory ("session cookie") or on the hard disk ("permanent cookie"). Cookies are not used to execute programs or load viruses to the user's computer. Rather, the principle purpose of cookies is to provide an offer that is especially tailored to the user and to make using the service as comfortable as possible. webCardinals mainly uses session cookies that are not stored on the user's hard disk and are deleted when the browser is exited. These session cookies are used for login authentication and system load balancing.
  41. webCardinals may perform or have performed analyses of the behaviour of its users in the context of the use of Grammati and to this end create anonymised usage profiles. This is done solely for the purpose of continuously improving the service provided by webCardinals. The evaluations and usage profiles are not related to persons but performed/drawn up in an anonymised manner.
  42. Where direct or indirect reference is made to links outside the area of responsibility of webCardinals, i.e. links to third party internet pages, webCardinals will be liable only if webCardinals knows the contents and it is technically possible and reasonable for it to prevent use in the case of illegal contents. For any content beyond this and in particular for damage resulting from the use or non-use of the information provided in this way, the operator of the pages alone is liable and not the party that solely makes reference to the relevant publication through links. webCardinals also does not adopt the contents of third party websites.
  43. All texts, images and other works created by webCardinals and distributed within the context of the language portal are protected by copyright. These contents are intended for personal, non-commercial use only within the framework of Grammati. Printouts and offline use are not permitted, unless where expressly offered by webCardinals. webCardinals reserves the right to prosecute or subject to civil proceedings any unauthorised use by way of complete or partial piracy, publication as well as reproduction or presentation of these contents or portions thereof.
  44. The Grammati logo and the company name webCardinals are legally protected. Their use and the use of other company names and trademarks appearing at Grammati requires the written consent of webCardinals.
  45. Agreements between webCardinals and the user shall be written and construed in accordance with the laws of the New Zealand
  46. Should individual points of these T&C be legally invalid, the remaining portions hereof shall be unaffected and remain binding.
